Terms of Use

Please read these Terms of Use ("Terms") carefully before downloading or using Callie's Mahjong (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms, Techsalot LLC ("Developer") grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, as permitted by the Apple App Store Terms of Service.

2. Restrictions

You may not: (a) copy, modify, or distribute the App; (b) reverse engineer, decompile, or disassemble the App; (c) rent, lease, lend, sell, or sublicense the App; (d) use the App for any unlawful purpose; or (e) remove any proprietary notices from the App.

3. Free Trial, Purchases and Subscriptions

The App offers a free trial period, a one-time purchase, and an auto-renewing subscription. All payments are processed by Apple and are subject to Apple's payment terms. The Developer never receives or stores your payment details.

Free trial. New installs include a free trial of the whole app, single player and playing with other people both. No payment is taken and no account is required. When the trial ends, continued play requires a purchase or a subscription.

One-time purchase — single player. A single, non-recurring purchase unlocks the complete single player game permanently. It does not expire, it is not a subscription, and it can be restored at no additional cost on any device signed in to the same Apple Account. It is enabled for Family Sharing. It does not include multiplayer.

Auto-renewing subscription — playing with other people. Playing with friends and family requires an auto-renewing subscription, offered as a monthly or an annual plan. The following terms apply:

• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription automatically renews at the end of each period unless it is cancelled at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the rate of the plan you selected.
• You can manage or cancel your subscription at any time in your Apple Account settings, under Subscriptions. Cancelling stops future renewals; it does not refund the current period.
• While the subscription is active it also includes the complete single player game and premium tile sets and themes. If the subscription lapses, multiplayer and any subscription-only content stop being available. Anything you bought outright, including the one-time single player purchase, remains yours.
• The subscription is enabled for Family Sharing.

Prices are shown in the App before purchase and may vary by country or region. The Developer may modify, discontinue, or adjust the pricing of its offerings at any time; a price change to an existing subscription will be handled in accordance with Apple's rules, which require notice and, in most cases, your consent before it takes effect. All purchases are final unless Apple's policies provide otherwise. Refund requests are handled by Apple.

4. Playing With Other People

The App allows you to play with other people either over a shared local network or online through Apple's Game Center. Online play requires an active subscription or an active free trial, together with a Game Center account, which is provided and administered by Apple under Apple's own terms. The Developer does not operate game servers; game information travels directly between the devices at the table.

The App provides no chat and no other free-form communication between players. The only information other players see about you is the display name your device provides and the ordinary public events of the game.

Multiplayer depends on your network, on the other players' devices remaining connected, and on Apple's services being available. The Developer does not warrant that a game can always be formed, that a session will be uninterrupted, or that an interrupted game can be resumed. If a player leaves or loses connection, the App may substitute a computer player so the remaining players can continue.

You agree not to interfere with, disrupt, or attempt to gain unfair advantage in a game with other players, and not to use the multiplayer features to harass any other person. The Developer may not be able to observe or intervene in games between players, as they do not pass through the Developer's systems.

5. Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for the App, as required by applicable law and these Terms. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App. For support, contact support@calliesmahjong.com.

6. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims relating to the App or your possession and use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar laws.

8. Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

9. Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of their terms. Upon termination, you must stop all use of the App and delete all copies from your devices.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict-of-law principles.

14. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
